Kanji Sensei Terms of Service

A. Definitions

  1. "Agreement": Refers collectively to all terms, conditions, and notices set forth within this document (the "Terms of Service" or "Terms"), along with any applicable operating rules, policies, and procedures referenced herein.

  2. "Content": Encompasses all creative works and materials presented on the Website, including but not limited to text, data, reading materials, graphics, media, artwork, software, applications, designs, features, audio, and other related materials.

  3. "Service": Refers to the applications, software, products, and services provided by Kanji Sensei.

  4. "Kanji Sensei," "We," and "Us": Refer to Kanji Sensei, LLC.

  5. "User": Designates any individual who accesses or utilizes the account, or who directs the use of the account to perform its functions. To be eligible to use the Service, Users must be at least 13 years of age. Special terms may apply to business or government accounts (see Section B.4: Additional Terms).

  6. "Website" or "Kanji Sensei": Refers to the Kanji Sensei website accessible at kanji-sensei.com.


B. Account Terms

  1. Required Information

    To complete the signup process, you must provide a valid email address. Additional information, such as your real name, is optional unless you are registering for a paid account, in which case further details will be required for billing purposes.

  2. Account Requirements

    • Only natural persons are permitted to create accounts.
    • Accounts created by automated means, including bots, are strictly prohibited and will be removed.
    • To create an account, you must be at least 13 years of age. Users under 13 are not permitted to use the Service, and any such accounts will be terminated immediately.
    • If you reside outside of the United States and your country's minimum age requirement differs, you are responsible for ensuring compliance with the relevant laws of your jurisdiction.
    • Usernames that infringe on the rights of others, including names or trademarks without appropriate authorization, are prohibited.
    • Additionally, usernames that are offensive, vulgar, or obscene are not permitted.
    • Account sharing is prohibited, and each account is for individual use only. Any accounts found to be shared may be subject to termination at Kanji Sensei's discretion.
  3. User Account Security

    You are solely responsible for maintaining the security of your account while using our Service. This includes, but is not limited to, the protection of your account and password. You are also fully responsible for all content posted and any activity conducted under your account. Kanji Sensei is not liable for any loss or damage resulting from your failure to meet these security obligations.

    If you become aware of any unauthorized use of your account or password, you must notify the Kanji Sensei team immediately.

  4. Additional Terms

    In certain situations, third-party terms may apply to your use of Kanji Sensei's services. For example, you may download an application that integrates with our Service. While these Terms of Service constitute our full agreement with you, please note that other third-party terms govern the relationships between you and those entities.


C. Acceptable Use

  1. Compliance with Laws and Regulations

    Your use of the Kanji Sensei website and Service must comply with all applicable laws, including but not limited to copyright, trademark, export control, and any other relevant laws in your jurisdiction. You are responsible for ensuring that your use of the Service adheres to all relevant laws and regulations.

  2. Content Restrictions

    You agree not to upload, post, or contribute any content that:

    • Is unlawful or promotes unlawful activities;
    • Contains sexually explicit or obscene material;
    • Is libelous, defamatory, or fraudulent;
    • Is discriminatory or abusive toward any individual or group;
    • Contains or distributes active malware, exploits, or is used for the delivery of exploits (such as part of a command and control system);
    • Infringes upon the proprietary rights of any party, including patents, trademarks, trade secrets, copyrights, rights of publicity, or any other rights.
  3. Conduct Restrictions

    While using Kanji Sensei, you agree not to:

    • Harass, abuse, threaten, or incite violence toward any individual or group, including the Kanji Sensei team and its users;
    • Use our servers to send unsolicited advertising or spam;
    • Attempt to disrupt or tamper with Kanji Sensei's servers in ways that could harm the Website or Service;
    • Impersonate any person or entity, including members of the Kanji Sensei team and its users, or violate the privacy of any third party by posting another person's personal information without consent.
  4. Services Usage Limits

    You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, access to the Service, or use of the Service without Kanji Sensei's express written permission. This includes, but is not limited to, written works, artwork, audio, videos, software, designs, and other intellectual property.

  5. Scraping

    Scraping refers to the automated extraction of data from our website, such as through a bot or web crawler. It does not include the collection of information via Kanji Sensei's API. Please refer to Section G for our API terms. Furthermore, you may not scrape Kanji Sensei for spamming purposes, including selling Kanji Sensei users' personal information to advertisers, recruiters, job boards, or any other third parties.

  6. Privacy

    Misuse of users' personal information is prohibited. Any person, entity, or service collecting data from Kanji Sensei must comply with our Privacy Policy, particularly concerning the collection of users' personal information. If you collect users' personal information from Kanji Sensei, you agree to use it solely for the purpose authorized by the user, ensure its security, and respond promptly to users' requests for removal.

  7. Excessive Bandwidth Use

    If your bandwidth usage is deemed excessively high compared to other Kanji Sensei users, we reserve the right to suspend your account or throttle your access until you reduce your bandwidth consumption.

  8. User Protection

    You agree not to engage in activities that significantly harm our users. Kanji Sensei will prioritize the protection of users and may suspend or terminate accounts involved in harmful activities, including disputes that negatively impact users as a whole.


D. User-Generated Content

  1. Responsibility for User-Generated Content

    You may create or upload User-Generated Content while using the Service. You are solely responsible for the content you post, upload, link to, or otherwise make available via the Service, and any harm resulting from such content, regardless of its form. Kanji Sensei is not responsible for any public display or misuse of your User-Generated Content.

  2. We May Remove Content

    While we do not pre-screen User-Generated Content, we reserve the right to refuse or remove any content that, in our sole discretion, violates any of our terms or policies.

  3. Ownership of Content, Right to Post, and License Grants

    You retain ownership of and responsibility for any content you create or own ("Your Content"). If you post content you did not create or do not own the rights to, you agree to assume full responsibility for that content, to only submit content you have the right to post, and to fully comply with any third-party licenses relating to the content you submit. Since you retain ownership and responsibility for Your Content, we require you to grant us certain legal permissions, as outlined in Sections D.4-D.5. These license grants apply solely to Your Content. If you upload content that already includes a license granting the permissions we need to operate our Service, no additional license is required. You understand that you will not receive any compensation for the rights granted under Sections D.4-D.5. The licenses you grant us will terminate when you remove Your Content from our servers.

  4. License Grant to Us

    To facilitate necessary actions, such as hosting, publishing, and sharing Your Content, you grant Kanji Sensei and its legal successors the right to store, process, and display Your Content. This includes but is not limited to, the rights to store Your Content in our database, create backups, present it to you and other users, parse it into a search index, analyze it on our servers, share it with other users, and perform it if Your Content consists of music, video, or similar media.

  5. Moral Rights

    You retain all moral rights to the content you upload, publish, or submit to any part of the Service, including the rights of integrity and attribution. However, you waive these rights and agree not to assert them against us to enable Kanji Sensei to reasonably exercise the rights granted in Section D.4, except as otherwise specified. To the extent this Agreement is not enforceable under applicable law, you grant Kanji Sensei the necessary rights to use Your Content without attribution and to make reasonable adaptations of Your Content as needed to operate the Website and provide the Service.


E. Copyright Infringement and DMCA Policy

If you believe that content on our website infringes upon your copyright, please contact us in accordance with our Digital Millennium Copyright Act (DMCA) Policy. If you are a copyright owner and believe that content on Kanji Sensei violates your rights, we encourage you to reach out to us directly.

Please be aware that submitting a false or frivolous takedown notice may have legal consequences. Prior to submitting a takedown request, you should carefully consider the potential for fair use or other legal exceptions, as well as any licensed uses of the content in question.

We reserve the right to disable and terminate the accounts of users who infringe upon the copyrights or other intellectual property rights of Kanji Sensei or its users, in appropriate circumstances, and at our sole discretion.


F. Intellectual Property Notice

  1. Rights to Content

    Kanji Sensei retains full ownership of all intellectual property rights associated with the Kanji Sensei Website and Service, including but not limited to artwork, designs, written content, HTML/CSS, JavaScript, and visual design elements. We reserve all rights not expressly granted to you under this Agreement or applicable law. You may not duplicate, copy, or reuse any portion of the artwork, designs, written content, HTML/CSS, JavaScript, or visual design concepts without the express written permission of Kanji Sensei.

  2. License to Kanji Sensei Policies

    This Agreement is licensed under the Creative Commons Zero license.


G. API Terms

All use of Kanji Sensei's API is governed by these Terms of Service and our Privacy Policy. By using Kanji Sensei's APIs, including access via third parties, you agree to comply with these Terms of Service, including Section G.

You may not abuse or overuse the API. Excessive or abusive requests to Kanji Sensei via the API may result in the temporary or permanent suspension of your account's access to the API. Kanji Sensei reserves the right, at its sole discretion, to determine what constitutes abuse or excessive usage. We will make a reasonable attempt to notify you via email prior to any suspension.

API tokens must not be shared in a manner that exceeds Kanji Sensei's rate limitations. Additionally, you may not use the API to download data or content from Kanji Sensei for spamming purposes, including selling Kanji Sensei users' personal information to recruiters, headhunters, or job boards.


H. Advertising

Kanji Sensei prohibits the use of its website for advertising purposes. Advertising content is limited to the promotion of personal projects or individual professional development. Advertising for business entities is strictly prohibited without prior approval. All advertisements, like any other content, must comply with applicable laws and these Terms of Service. Kanji Sensei reserves the right to remove any advertisements that, in our sole discretion, violate these terms or policies.


I. Payment

  1. Pricing

    You are responsible for any fees associated with your use of Kanji Sensei. If you agree to a subscription price, that price will remain fixed for the duration of the payment term. However, prices may change at the end of the term. If subscription prices decrease during the middle of a payment term, you may benefit from the lower price before your next payment cycle begins.

  2. Upgrades, Downgrades, and Changes

    You will be billed immediately when you upgrade from the free plan to any paid plan. If you change your level of service, we will prorate the cost difference and apply any charges or discounts immediately. For example, if you upgrade from a yearly plan to a lifetime plan, you will only be charged the difference for the remaining term.

    You may adjust your service level at any time by selecting a different plan option or modifying your subscription settings. If you downgrade your account, please note that you may lose access to certain content, features, or capabilities based on your new plan.

  3. Billing Schedule; Refunds

    For monthly or yearly payment plans, the Service is billed in advance on a monthly or yearly basis, respectively. For lifetime plans, the Service is billed once at the time of purchase.

    Once you pay for a selected term, you are committed to that term for its duration. Refunds will not be issued unless there is a valid reason. However, you may request a refund within 30 days of purchase if you have a valid reason for doing so.

  4. Authorization

    By agreeing to these Terms, you authorize Kanji Sensei to charge your approved payment method on file for any fees you incur related to the use of the Service.

  5. Responsibility for Payment

    You are responsible for all fees, including taxes, associated with your use of the Service. By using the Service, you agree to pay Kanji Sensei for any charges incurred in connection with your use. If you dispute any charges, you are responsible for providing a valid payment method for paid accounts. Free accounts are not required to provide payment information.


J. Cancellation and Termination

  1. Account Cancellation

    You may cancel your subscription at any time. Your access to paid content and features will remain active until the end of your current billing period. After the billing period concludes, access to paid content and features will be revoked, but your account will remain accessible. You can re-subscribe at any time. To keep your account accessible, we will retain your data until you request account deletion.

  2. Account Deletion

    You may delete your account at any time through your account settings. Please note that we are unable to process account deletions via email. If you choose to delete your account, any remaining paid subscription time will be forfeited, and no refund will be issued. Deleting your account will remove all associated data, though you may re-subscribe at any time.

  3. Upon Deletion

    We may retain and use your information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. However, unless required by law, we will delete your full profile immediately upon account deletion. Please be aware that some information may remain in secure backups, and once your account is deleted, this data cannot be recovered.

  4. Termination

    Kanji Sensei reserves the right to suspend or terminate your access to all or part of the website at any time, with or without cause, and with or without notice, effective immediately. We also reserve the right to refuse service to any individual for any reason at any time.

  5. Survival

    Any provisions of this Agreement that, by their nature, should survive termination will continue to apply, including, but not limited to, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.


K. Communications

  1. Electronic Communication Required

    For contractual purposes, you consent to receive communications from us in electronic form via the email address you have provided or through the Service. You agree that all Terms of Service, Agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirements that would apply if those communications were provided in writing. This section does not affect your non-waivable rights.

  2. Legal Notice

    Communications made through email or Kanji Sensei's messaging system do not constitute legal notice to Kanji Sensei in situations where notice is required by contract, law, or regulation. Legal notice must be served in writing.

  3. No Phone Support

    Kanji Sensei does not offer phone support. We provide support exclusively via email.


L. Disclaimer of Warranties

Kanji Sensei provides the Website and the Service "as is" and "as available," without any warranties of any kind. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, whether express, implied, or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement.

Kanji Sensei does not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free; that the information provided through the Service is accurate, reliable, or correct; that any defects or errors will be corrected; that the Service will be available at any specific time or location; or that the Service is free of viruses or other harmful components. You assume full responsibility and risk for any loss resulting from your use of the information, content, or other materials obtained.


M. Limitation of Liability

You understand and agree that Kanji Sensei will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, regardless of how they arise, including but not limited to:

Our liability is limited regardless of whether we have been informed of the possibility of such damages, and even if a remedy provided in this Agreement fails in its essential purpose. We will not be liable for any failure or delay arising from matters beyond our reasonable control.


O. Changes to These Terms

We reserve the right, at our sole discretion, to amend these Terms of Service at any time, and will update them accordingly. We will notify users of material changes to this Agreement, such as price adjustments, at least 30 days prior to the changes taking effect by posting a notice on our website. For non-material modifications, your continued use of the website constitutes your acceptance of the revised Terms of Service. Additionally, we reserve the right, at any time and from time to time, to modify or discontinue the website, temporarily or permanently, with or without notice.


P. Miscellaneous

  1. Governing Law

    Except where applicable law provides otherwise, this Agreement between you and Kanji Sensei, as well as any access to or use of the website or the Service, are governed by the federal laws of the United States of America and the laws of the State of Florida, without regard to its conflict of law provisions.

  2. Contests, Sweepstakes, and Promotions

    Any contests, sweepstakes, or other promotions made available through the Service may be governed by rules separate from these Terms. If you participate in any promotions, please review the applicable rules in addition to our Privacy Policy. In the event of a conflict between the promotion rules and these Terms, the promotion rules will take precedence.

  3. Non-Assignability

    Kanji Sensei may assign or delegate these Terms of Service and Privacy Policy, in whole or in part, to any person or entity at any time, with or without your consent, including the license grant in Section D.4. You may not assign or delegate any rights or obligations under these Terms of Service or Privacy Policy without our prior written consent. Any unauthorized assignment or delegation by you will be considered void.

  4. Severability, No Waiver, and Survival

    If any part of this Agreement is found to be invalid or unenforceable, that portion will be interpreted to reflect the parties' original intent. The remaining portions will remain in full force and effect. Any failure by Kanji Sensei to enforce any provision of this Agreement will not be considered a waiver of our right to enforce such provision. Our rights under this Agreement will survive any termination of the Agreement.

  5. Amendments; Complete Agreement

    This Agreement may only be modified by Kanji Sensei in accordance with Section O, 'Changes to These Terms.' These Terms of Service, together with the Privacy Policy, represent the complete and exclusive statement of the Agreement between you and Kanji Sensei. This Agreement supersedes any prior proposals or agreements, whether oral or written and any other communications between you and Kanji Sensei regarding the subject matter of these Terms, including any confidentiality or nondisclosure agreements.
